ACM Design Company Terms & Conditions

The following terms and conditions apply to all transactions with the ACM Design Company.
The placing of an order indicates your acceptance of these terms and conditions. Please read them carefully.
These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 128 years of age and I have the right to refuse at my discretion any goods ordered by you.
1.0 No Waiver
My failure to insist upon strict performance of any provision of these Terms & Conditions, shall not be deemed to be a waiver of my rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.
2.0 Description of Goods/Warranty and Liability
Although I warrant that the goods will, at the time of delivery, correspond to the description given by me, all products I sell are of a technical nature and it is not practical to publish detailed specifications of all the products. All images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods.
3.0 Products
I reserve the right to alter any details of products advertised without notice and while every effort is made to describe goods accurately in the advertisement no warranty is given as to accuracy and no responsibility will be accepted for error or mis-description and any resulting loss.
4.0 Supplied Customer Artwork In ‘Print Ready’ Format
All artwork supplied by customers must be supplied in CMYK format. The ACM Design Company cannot be responsible for any colour shift that may occur when converting from RGB to CMYK.
4.1 All artwork must satisfy certain criteria. The ACM Design Company is not responsible for images that may be blurred or pixelated due to inaccurate customer-supplied artwork if it is less than 300dpi. I require a 3mm bleed on all edges if the document requires this. If you are unsure of the term ‘bleed’ then please contact me. If the artwork supplied is not ‘print ready’ then the ACM Design Company will contact you in order for you to re-supply or to make amendments and endeavour to get your order to print as soon as possible. If artwork supplied by the customer is not print ready and in CMYK format I reserve the right to charge a small fee for converting this – but I will advise you of any costs beforehand. Any delays in artwork not being supplied ‘Print Ready’ may lead to your order missing the desired delivery slot.
5.0 Complaints
Any complaints must be made within 24 hours of receiving your goods. Any complaints made after this time period are void of any right to refund or reprint. I have the right to resolve any complaint within my own discretion and I will not be liable for any loss of income, loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of opportunity even if I had knowledge that such damages or loss might arise for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation breach of contract, negligence, willful act or default.
6.0 Printing Defects
Customers must notify ACM Design Company in writing (or via email) within 24 hours of delivery of any defects discovered in the finished goods. In order to receive any replacements The Customer must return 95% of the delivered product within 7 days of delivery. The ACM Delivery Company shall not be liable for any costs, expenses incurred by the customer or any person or 3rd party company arising directly or indirectly out of any print error. In the event that I have printed a document incorrectly and found to be my fault then I will supply a full re-print without cost to the customer. If the customer wishes to alter the artwork prior to re-print then this will be treated as a new order and be subsequently charged for.
7.0 Quantity Changes To Orders
Any changes in quantity ordered must be made in writing (or via email) prior to commencement of processing. Any increases in the order must be regarded as a separate contract unless written notification is received before work commences on the original order. I reserve the right to alter the delivery date agreed initially due to my having to potentially order in more materials to achieve a desired larger quantity.
8.0 Quantity Variation
I shall be deemed to have fulfilled my contract by delivery of a quantity within 5% plus or minus of the quantity of printed goods ordered and you will be charged at the contract rate for the quantity delivered.
9.0 Paper Quality
I cannot guarantee the paper quality will be exactly the same as previous orders or samples received as I buy and source my paper and other materials from a variety of paper mills and merchants who stock a large number of paper pallets. My paper cannot be compared like for like to other printers, the paper may vary slightly from other paper’s texture (rough, smooth). colour, grain etc.
10.0 Paper Grams (GSM)
I cannot give 100% guarantee of the grams (GSM) as I buy from paper merchants with certificate of paper grams. (+-) 5% variant of paper grams (GSM) can happen due to large volumes of paper purchased from different paper merchants.
11.0 Delivery
Every effort will be made to deliver on time, but any delivery day specified is a ‘best endeavour’ and no liability is accepted for any loss arising from delay or error in the delivery of the goods. I will do my very best to ensure that an order is dispatched on the day specified. I cannot give an exact delivery time guarantee or ensure that the delivery will be made on as per my indicated time, as I sometimes have to rely on a third party delivery company/courier. There is a high probability that the delivery times calculated on the website are maintained if orders are received by specified time and are base on customers supplying ‘print ready’ artwork. Any delays in artwork not being supplied ‘Print Ready may lead to your order missing the desired delivery slot.
11.1 The ACM Design Company shall not be liable for any losses, costs, damages or expenses incurred by The Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date. I will not be under any liability whatsoever in the event that I am prevented or delayed from supplying or making delivery of any Goods by any reason or cause beyond my control.
11.2 Any delivery times given are estimated and might be extended in connection with high volume of orders.
11.3 If an order is delivered to the wrong delivery address due to the customer providing me with the wrong address, then it’s possible that the consignment will be turned back. In the event of this happening I will try to arrange re-delivery of the consignment to the correct address and charge for any additional delivery cost. If it is possible for the parcel to be intercepted before its return, then I will do my best to get the consignment returned to the local depot and then re-delivered without cost. However, if the new delivery address does not fall under the delivery area for that depot and needs to be transferred to a different depot for delivery then there will be an additional delivery charge.
12.0 Order Returns, Cancellation, Refund
Due to the nature of personalisation of products I sell, reimbursements for products already printed or submitted for print is not possible. It is possible to cancel orders that have not been produced or sent for print. In that case I am entitled to charge a £20 administration fee towards some of the time spent processing and designing the order.
13 Liability
Save in so far as defects in the goods cause death, injury or damage to personal property, my liability for any loss or damage suffered by you in respect of the goods shall be limited to the contract value of the goods. I will not be liable for any loss of income , loss of profits, loss of markets, loss of reputation, loss of customers, loss of use, loss of an opportunity even if I had knowledge that such damages or loss might arise or for any indirect, incidental, special or consequential damages or loss howsoever arising including without limitation breach of contract, negligence, willful act or default in lieu of any unfulfilled order.
14.0 Severability
In the event that any or part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
15.0 Force Majeure
I will not be held responsible for failure or delay in the carrying out of my obligations under the contract arising from any cause outside my reasonable control or by inability to procure materials or articles except at higher prices due to any such cause and in such circumstances I shall be entitled by notice to terminate the contract in whole or in part without incurring any liability whatsoever to you.
16.0 UK Customers Or International
The ACM Design Company is intended for customers residing in mainland United Kingdom. I don’t accept orders from international customers as I don’t deliver internationally. It may be possible to deliver certain items internationally, but the expense would lie with yourself. Please contact me to discuss any special delivery requirements you have.
17.0 Payment Method
Unless under prior credit agreement, all orders must be paid for on receipt of an invoice. Full payment must be received following receipt of this invoice. All prices quotes are in Pounds Sterling and payment in any other currency cannot be accepted. Payment for the goods which include any applicable delivery charges are to be made by cash, cheque, credit/debit card or bank transfer. I am pleased to accept cheques made out to “ACM Design Company”, however all funds must be cleared prior to commencement of any printing. If paying by Bank Transfer please use the invoice number as the reference.
18.0 Quotations
Orders are accepted subject to my right to adjust prices to take account of any changes in the law or Government regulations requiring me to increase prices by way of direct taxation, import duties, customs and excise duties or otherwise. The prices are based on today’s current cost of production and in the event of any increase in wages or cost of materials to me occurring after the confirmation of accepted contract, I shall be entitle to charge such increases to you. Quotations are valid for one calendar month from the date on the quote.
19.0 Price Match Guarantee
I do not operate a price match guarantee. In the unlikely event that you find a price lower than that offered to you by way of my quote, I reserve the right to try and match (if possible) or refuse to match the price that has been found.
20.0 VAT
Where applicable all prices quoted are not subject to VAT at the current rate as I am not VAT registered. Some items are VAT free, but some printed items become ‘vatable’ if a) they have space left on them to write, b) they are used as entry to an event and c) if they are used for monetary discount off a goods or service. If this is the case with your print I am entitled to charge you the equivalent of the VAT amount that I will have to pay.
These Terms & Conditions shall be construed in accordance with English Law
